Kansas’s snow is causing many injuries and potentially premises liability lawsuits

This years winter storms continue to cause injury to Kansans, even with the roads cleared. An awning in Overland Park seriously injured a man when the weight of the snow caused it to collapse. The Overland Park Fire Department responded to a condominium building a few weeks ago and found the man unconscious. He is in serious condition.

The department said that a similar collapse happened the day before that was reported by neighbors. They believe the heavy weight of the snow is what caused the awning to collapse. The Kansas City area received snow accumulation of more than a foot.

The Overland Park Building Safety department is investigating the accident. Because it happened at a condominium building, and not a private home, the owners of the building may be responsible for the damages caused to the man. According to premises liability law, when someone is injured as a result of unsafe property or building conditions, they may have a right to make a claim for their damages against the owner of the property.

Property owners have a “duty of care” to see that their property is safe. This includes insuring that the building has no structural defects that could cause an accident, both inside and out. In some states the property owner may also have a duty to reduce problem areas caused by weather. A plaintiff also has a duty to exercise reasonable care, so if any action of the man contributed to the accident, he may share in the negligence.
