Rebecca Baker v. Stu Emert Chevrolet

Rebecca Baker was injured when the truck and trailer lost control on an icy bridge and skidded directly into her path of traffic. Stu Emert claimed the driver was an independent contractor and that they were not responsible. We were able to establish that Stu Emert Chevrolet was engaging in interstate commerce and that they failed to properly register with the DOT. We were also able to show that they failed to properly train their alleged independent driver and had expert testimony showing the the independent contractor was nothing more than a sham. Rebecca had neck and back injuries about about 26,000 in medical bills. The case settled at mediation for substantially higher than the original offer to the referring attorney.
