Gravity blamed for surprising verdict

Injuries sustained by a mechanic while repairing an elevator reached a surprising verdict in the Courtroom. The Judge ruled against elevator mechanic Eladio Garcia because gravity was actually at fault.

Garcia received injury to his hand after a thin strip of metal on the elevator snapped. Garcia then filed a claim against the owner of the building where the incident occurred. However, Garcia’s claim was dismissed by Judge Ben R. Barbato.

The building owner got off the hook in this lawsuit because the Judge ruled that the force of gravity was found to be at play. Overhead hazards of a falling object that Garcia was subjected to also caused his claim to be dismissed, as well as Garcia failing to provide sufficient evidence that the building owner controlled his work. His evidence also lacked proving that the owner knew of safety hazards that led to Garcia’s injury.
