Many work place injuries will allow you to return to light duty at work. In doing so, employers are required to return the worker to the job he or she left or a similar job, if such a position is available. Since some states require the employer to continue paying workers’ compensation benefits to compensate the worker for the wage difference in their regular position, some employers claim they do not have a light duty position available.
If you return to work, even light duty work, make sure your employer knows the restrictions placed on you. If your employer asks you to complete a task you are forbidden from doing, decline and let the employer know you are restricted from performing that task. Also, document the incident, in case further incidents arise. You cannot legally be fired for not doing a task your doctor has prohibited. However, your employer can say the do not have a position that will accommodate your restrictions. In this circumstance you may qualify for a work disability.
