The U.S. Federal Trade Commission has closed a Texas-based debt collection office after finding that the company used deceptive and abusive scare tactics to force people to pay their payday loan debts. One of the methods used is to pose as a law firm and claim to be working with law enforcement. They even charge illicit attorney fees.
This is just one example amongst a vast variety of tactics debt collectors have used. Not only will they promise to incarcerate debtors or take their children into custody, they even say they will kill family pets or dig up the dead relatives of those who couldn’t pay their funeral bills.
According to the Fair Debt Collection Practices Act, all of these activities are illegal, as is threatening violence, using profane language, calling incessantly, inflating a debt and implying they are attorneys. Unless the debt collectors are legally able with a Court order, they cannot tell clients they will arrest them or garnish their earnings or property.
